DISCLAIMER:

Not sure what this guy is trying to say here…other than the fact that he is fishing for information on a decision that was warranted given climate within the University, and that he holds "union values" - as evident by the site's purpose.

Pay for performance, backed by a need for service validated by enrollment numbers, is always the best academic management philosophy, IMO.

Tenure is a flat out joke.  That's why virtually no for profit firms honor it today.  Associates can squat jobs based on how long they have been there and reside comfortably within a setting.

Business needs changes, and so should the cost allocations of the company.

If one wants to remain on board and gainfully employed, be prepared to constantly improve your self worth and value to the firm, or siliently move along.

Media relations departments have the opportunity to charge per copy for public records request. So do city offices, state offices, etc.

The University Press, the Palm Beach Post, etc. have to pay for them, and I don't think any individual or the UFF-FAU would be an exception.

Let's not forget that whether or not you agree with the UFF-FAU point of view on the tenure issue, they have a slanted opinion and didn't offer FAU's side of the story on the public records request.

There's two or three staff members handling ALL media requests for the university. And depending on what kind of records the UFF-FAU were requesting, it may take a long time to fish though millions of pages of records to find something.

I stand behind the FAU Media Relations office on this, especially because the author didn't sign their name to the blog entry — unless that's Jim Tracy's blog (and his name is on the side). For those of you that had Jim Tracy as a professor (I did), he's a brilliant man with very extreme opinions sometimes.

The state of Florida as well all know has the "Sunshine Law"

119.01 General state policy on public records -
(1) It is the policy of this state that all state, county, and municipal records are open for personal inspection and copying by any person. Providing access to public records is a duty of each agency.

With that said under the same statute, the party requesting records must give written notice of request to the agency.  In turn the agency must provide requestor with document, and I quote, within a reasonable time.  Now I worked at a law firm for four years which focused on land use and we always filled out Public Request.  Commonly "REASONABLE TIME" is 14 days, in this case, I believe that FAU gets tons of requests per day from every which way so a longer wait period could be "reasonable"

Brogan's response to United Faculty of Florida-Florida Atlantic University Chapter's "distractions and vitriol":

Dear Governor Crist:

We recently learned that the FAU chapter of the United Faculty of Florida (“UFF”), the union that represents some faculty at Florida Atlantic University, contacted your office about the “unchecked power and questionable judgment of the University’s top administrators and Board of Trustees” in regard to the reorganization of the College of Engineering and Computer Science and the layoff of five tenured faculty.

The sentiments that the UFF shared with your office were also posted on their blog, and we are disappointed by the level of vitriol in their latest posting.  In June, we met with our Board of Trustees to continue updating them on our budgetary process, which, as you know, was an arduous task.  We struggled to protect the academic core of the institution so that our students and faculty would be least impacted.  Like so many state universities, we had to make tough decisions to balance our budget, trying to impact a limited number of faculty positions.  During that BOT meeting, it was made clear that we were committed to working to find placement for these faculty elsewhere in the University where practicable.  Sadly, the value we place on tenure has been impugned by the negative characterizations by the UFF; however, we are confident that the vast majority of our faculty sees through the UFF’s distractions and understands that FAU continues to be committed to its faculty.

From the outset, University leadership has been in constant dialogue with the affected faculty members in an effort to find resolution.  In fact, as soon [as] it became feasible, all five faculty members were offered an extension of their layoff notice period with assignments in other academic units for the entire 2009-10 academic year.  We are now exploring all avenues to determine if these assignments can extend past this academic year.  It appears that the leadership of the faculty union is either confused or uninformed, since the posted blogs and correspondence with state leaders, including yourself, do not refer to the productive discussions that have taken place and continue to take place with the five affected faculty members.

Despite the rhetoric of the UFF and its negative effects, please be reassured that FAU’s leaders continue to work each day for a resolution that is beneficial to FAU - its students, faculty, staff and community.
