SBC explored legality of excluding ULL/ASU

Reading this, it seems like the SBC explored the legality of excluding ASU and ULL:

One day after UL and Arkansas State were left out of the bowl picture, the Sun Belt released a statement addressing some of those issues.

Troy and Florida Atlantic both earned bowl invites. The Trojans will play Southern Miss in the New Orleans Bowl on Dec. 21. The Owls will take on Central Michigan in the Motor City Bowl on Dec. 26 in Detroit.

Here's the Sun Belt's statement:

"As a result of Troy’s success in 2007, the Sun Belt Conference secured agreements with the Papajohns.com., magicJack St. Petersburg and Independence Bowls to ensure that schools with 7-5 records would have the opportunity to participate in a post-season bowl in a geographically conducive city that would bring fans and foster support for the respective bowl. This objective was met in that had Troy been defeated by Arkansas State on Saturday night, the agreement would have gone into effect which would have placed one of the two conference schools with a 7-5 record (Troy) into the Papajohns.com Bowl.

"Last week, the secondary part of the agreement which was established at the request of our bowl partners – SBC schools with 6-6 records having priority over other schools with 6-6 records as long as all schools with winning records (7-5 and better) were placed – was called into question. In discussions with the Sun Belt Conference’s legal counsel, the league office was made aware that language in the contracts would not be strong enough to guarantee a spot in the secondary bowl games for teams with 6-6 records. The league was reassured that Sun Belt teams with 7-5 records would be placed in these games if available.

"Upon reaching this determination, the conference office and its member institutions that achieved bowl eligible status worked tirelessly to present our case to bowls with openings. Although we share the disappointment of our institutions that did not secure a bowl bid, we take some comfort in that for the first time in our history the conference secured an at-large selection for a team with a 6-6 record and will have multiple participants for the third time since the SBC began sponsorship of FBS football only eight years ago."

Re: SBC explored legality of excluding ULL/ASU

"The Owls became only the eighth team in NCAA history to make a bowl after opening the year 1-5."

Another feather in our caps!
