Brogan: Davenport "repeatedly" threatened to sue

Topic Galleries - South Florida Sun-Sentinel.com

"Dr. Davenport told us, repeatedly, of his intention to sue us," Brogan said.

Here is the full text of President Brogan's statement:

http://www.sun-sentinel.com/media/acrobat/2007-12/34234196.pdf

In our responses to the AG, we explained that when I sat down with Dr. Davenport in March to discuss my desire to remove him from his position as advancement vice president, he indicated that such a termination, coupled with his age and status, would make it extremely difficult or impossible for him to find employment comparable to that which he held at FAU. We pointed out to the Auditor General that Dr. Davenport is an African-American male over age 60, who held an extremely high-ranking position at the University reporting directly to the President. We informed the AG that Dr. Davenport asserted to me, to Dr. Jessell, and to our General Counsel that he would bring suit against the University in order “to be made whole” for the losses that he would incur in connection with his separation from employment. We shared with the AG that based upon extensive dialogue with Dr. Davenport, our legal analysis anticipated that Dr. Davenport’s suit against the University would be for contract, tort and civil rights claims related to his separation from employment. We also reminded the AG that Dr. Davenport’s age and race are both within protected legal classifications under federal and state law, and that civil rights claims based on either classification receive heightened judicial scrutiny.

Re: Brogan: Davenport "repeatedly" threatened to sue

this would never happen in private business - succumbing to to idle threats from a "protected class" to "sue" over wrongful firing…

the guy didnt do his job…

if he worked where i worked, his a$$ would have been out, with no cash…and he would have even had to wait for his personal office belongings to be returned in the mail - via UPS ground…

"he indicated that such a termination, coupled with his age and status, would make it extremely difficult or impossible for him to find employment comparable to that which he held at FAU"…what a stinkin crock of crap that is…….its called "Time to hang it up buddy"…we dont NEED folks who want to throw thier weight around under a lofty, highpaid, position that dont earn thier keep…and the reason you could find comparable employment is because you have to earn things in private business - not get a good ol boy,um excuse me "protected class ol boy" "position" handed to them…

i dont care how high up you are…if you dont pull your weight, STEP DOWN with character..

Davenport, we dont OWE you anything…you owe FAU ALOT…and failed…obviously…

state ran bueracracy at its finest…once again costing the tax payer, and in this case student…

unbelievable…

to be honest i am surprised Brogan caved in to his "demands"…should have told him "fine go ahead and sue, see you in court"…

when they hire someone moving forward, it needs to be spelled out CLEARLY what is expected of them….then if they dont perform, the get the axe…bottom line…

waste, waste, waste…when will it ever end at FAU?

probably never.

sorry for the rant…this got me fired up when i read it…

This is why it is important to have legal counsel when developing contracts for high professions.  Frank learned a valuable lesson.

Like things, love people.
