folding chairs in the parking lot would be better. were always going to be missing the better recruits not having an on campus stadium and bringing the program to the next level. it can't get any better then we've already done. its going to be stuck at this level till were playing on campus. you can only squeeze so much out of nothing.

you think guys like Cyrille would have gone to WMU if we had a stadium? i'm not saying the guys we have aren't good, i'm saying if we got better guys how much better could howard & co.  could make them.

Has there been any word regarding tailgating once the stadium is built? I read on Ted's blog, that the Dirty Birds weren't allowed to bring in beer to watch the spring game, so wondering if that will be a continuing rule once the stadium is on-campus. I would hope they would allow drinking, but who know….

This definitely came up in a thread before because FAU recently re-wrote the "guidelines" about having vehicles parked before and after events…

I heard a rumor that one of the DBs also had funnel(s), which I believe are against FAU tailgating guidelines - thus they weren't allowed in to the spring game. I don't want to stir up that argument again, but if that is true, that's why they weren't allowed in. If it's not true, well then, who knows why they weren't allowed in the spring game.

But anyway…. As far as tailgating on campus - I'm sure this will be a point of contention when we get the stadium. But there are NCAA regulations and legal liabilities to take into thought.

A study by John Miller (Texas Tech) and Andy Gillentine (U of Miami) reported:
“Tailgating has become one of the most influential phenomena in today’s sport industry. It may be most prominent at collegiate football games. Tailgating can be a major part of a positive “whole day” experience for students, alumni and supporters.”

Take into consideration the case of Bearman vs. Notre Dame in 1983. Spectator Bearman was tripped AFTER the game by a drunk fan who was tailgating after the game in the parking lot of the stadium. She sued ND and won - thus came the new case law basis for future liability for universities and tailgating. The judge said that ND should have "forseen" this as a potential problem and added that ND should  "anticipate that intoxicated actions of some tailgaters may endanger others."

"Foreseeability" is what tailgating policies are structured around- as well as university rules, NCAA rules, city rules, etc. that influence tailgating rules. That's also where no kegs, no large beer containers, no drinking games, no glass, no open flames, etc. regulations come into play at my schools here in Texas and across the nation.

foreseeability defined:“Foreseeability:”
- It’s the most significant consideration in determining the extent to which a person is owed a duty of responsible care (Rodriguez v. Sabatino, 1997)
- Considered to the “the degree to which the university knew, or should have known, that an invitee may be exposed to the probability of injury”
- Turpin v. Granieri (1999) said that “lack of safety may be the reason or proximate cause of the damage” than the sports event manager is liable.

Also:
There are three types of event entrants: trespassers, licensees and invitees. Sports event attendees are considered invitees
- "Venue has duty to protect invitees from foreseeable third party harm" (Hills vs. Bridgeview Little League Association, 2000)

Pretty sure it wasn't even about the beer…it was about FAU wanting a lock on the vending and they had asked that folks not bring in personal beverages, and food…

Very interesting legal stuff….it definitely affects how universities prepare for on campus events….

Yeah, I agree. Athletics just trying to grab some bucks during the lean part of the season. they figured attendance would be ok (and it was) so they wanted to take advantage. Nothing wrong with that…
