FIU faces NCAA violations for competing with ineligible athletes

FIU faces NCAA violations, including institutional control on more than one level, for allowing 40 athletes in the years 2002-2003 and 2006-2007 to compete who were ineligible.
In a "notice of allegations," sent to school President Modesto A. Maidique, the NCAA refused to resolve the case through summary judgment. A hearing before the NCAA Infractions Committee is likely to occur early next year.
"We are not proud of these findings," said Maidique in a statement. "The fact that we identified the issue, reported it and took decisive steps to correct it sends the clear message that FIU is looking to build a strong and compliant program."
The NCAA alleges that the university failed to have adequate systems and resources in place to advise and monitor student-athletes with regard to certifying NCAA eligibility and review and apply financial aid.
During 2002-2003 and 2006-2007, the NCAA alleges that the institution inconsistently applied legislation governing fill-time enrollment, the five-year rule and the progress-toward-degree requirements leading to the 40 athletes in question, who were ineligible, competing.
In 2004-2005 and 2006-2007, the NCCA alleges that FIUthe institution incorrectly applied financial aid legislation that resulted in thethree athletic departmentsports exceeding the maximum aid allowed.
FIU has to provide information on any additional violations discovered during its investigation, corrective or punitive actions implemented and disciplinary measures imposed.
"It was a breakdown in the institution's certification program," athletic director Pete Garcia said. "We have added four people in compliance and committed $250,000 in resources to our athletic support program this year. We have also withheld scholarships in every sport."
The university has hired seven new coaches and instituted a training program for employees working directly with student-athletes.
"I feel very confident that we are building a solid foundation to ensure total compliance with all NCAA regulations," Garcia said."

If found guilty, could this mean any victories would have to be vacated?
That is a good point. Unfortunatley the 52-6 to FIU loss doesn't appear to be in one of the years in question.
